The New Mexico Constitution vests the District Court with supervisory control over the inferior (lower jurisdiction) courts located in the judicial district. Presently, the Third Judicial District encompasses all of Dona Ana County and includes the District Court plus the lesser jurisdiction courts: the Probate Court, Dona Ana County Magistrate Court, and Municipal Courts in Las Cruces, Mesilla, Hatch and Sunland Park. All lower court judges may perform wedding ceremonies. The Probate Court is located at 180 W. Amador. The current Proba te Judge is Olivia Garcia. MAGISTRATE COURT The Magistrate Court is located at 110 Calle de Alegra, Las Cruces, NM 88005. There are also circuit divisions of the Magistrate Court in Hatch and Anthony. There are five judges at the Magistrate Court: Oscar Frietze, Joseph Guillory, Olivia Nevarez-Garcia, Richard Silva and Kent Wingenroth. The Court Manager is Bernice Ramos. The Magistrate Court has jurisdiction over misdemeanor criminal offenses committed in Dona Ana County (such as traffic tickets, DWI, and other non-felony cases), landlord - tenant disputes, violation of County ordinances, and other small claims (up to $10,000 in dispute) of a civil nature. MUNICIPAL COURTS The Municipal Courts have jurisdiction over misdemeanor crimes committed within the city limits, DWI and traffic tickets, and violations of city ordinances The Las Cruces Municipal Court is located at 135 E. Griggs Street in Las Cruces. The Chief Judge is Melissa Miller-Byrnes and Judge Jim Locatelli presides over Division II. The Chief Clerk is Lisa Sanchez. For information, call (575)541-2224. The Mesilla Municipal Court is located at 2670 Calle de Santiago in the Town of Mesilla, just west of Las Cruces. Lionel Frietze is the Municipal Court Judge for the Town of Mesilla and Lydia Guaderrama is the Chief Clerk. For information, call (575)524-1091.
